This research purpose to examine the responsibility of Indonesia as a transit states for refugee children based on International law. Methods of research using the normative legal research with statute approach, conceptual approach, and comparative approach. The results of this research : one, that the legal protection for refugee children according to the national law which refers to the Law No. 23 of 2002 on Child Protection which is under Article 60 mention that children must be protected and receive special protection is Children in emergency situations as referred to in Article 59 which one of them is a child who are refugees. Two, that the protection of refugee children according to the International law according to Article 22 of the Convention rights of the child. In addition and according to the customary International law when a state protecting its human rights principles, then indirectly also requires the state protect the rights of refugee children.
