Conflicts, either light or heavy, are inevitable amongst married couples. Such conflicts often cause serious problems within marital bonds. They lead into quarrels, tension and even violence. As a result, one party decides to leave out as a protest against his/her couple bad attitudes. This arises when either party feels being treated unfairly or when either party does not fulfil rights and obligation. In Islamic law, this is called as nusyuz (rebellion) where the couple is no longer happy with his/her spouse due to unfulfilled rights or obligation or some other serious matters. This article discusses the normative Islamic legal stipulation about nusyuz, which is seen as the mechanism to settle marital disputes among married couples. It requires that each party complies with the law and fulfils his/her rights and obligation in order to keep the conjugation worked properly. When this mechanism fails to reunite the couple, divorce is the last and best resolution.
