The position of sharia as a source of the national law is very dynamic. In field of family law, especially of the law of marriage, the codification of sharia in the positif law is massive. For contrary, the sharia does not become the principal sourcefor the national legislation, such as the employment field, if we compare with the west law. In the economic area, although Islam only talk general principt of economic, especially the aspect of sharia contract, but widely adopted in several practice of economie especially in the Islamic economic transaction. The adaptation of charia in Indonesia showed a larger trend than in one other country, Maroko. The charia has a possibility became the main reference of the national law, as the secondary source or additional.
